The Environment & Land Tribunals Ontario has ruled that CN Rail must cover the added costs incurred by the Ministry, stemming from two train derailments near Gogama in 2015.

They will have to cover the full $619,343.42. CN was seeking relief of $531,213.67.

In a 33-page document—which you can view HERE—on the case, it outlines that CN “has failed to show that any costs or expenses in the Orders and Additional Costs did not arise from the spills…that any costs or expenses were not ‘incurred,’ that any costs or expenses do not fit within the purposes of section 99.1(1) (of the Environmental Protections Act), or that any costs or expenses were unreasonable having regard to what was done.”

The first spill happened February 14th, 2015 in Regan Township and the other happened March 7th just outside Gogama. The two derailments were about 14 kilometres away from each other.
